The battle against spam is far from won with the implementation of the Directive on Privacy and E-Communications (2002/58/EC) into UK law on 11 December.

The first reason is that the bulk of spam originates from outside the UK in jurisdictions where spammers appear to be able to act with impunity.

The second reason is that there is no restriction on the sending of unsolicited e-mails to corporate subscribers. The struggle to keep spam out of the corporate in-tray seems to be set to continue. / read more

Antigua & Barbuda has brought the first test case involving the provision of cross-border electronic services before the World Trade Organisation's Dispute Settlement Procedure. Antigua is challenging the US government's action against online gambling claiming that it is in breach of the GATS agreement.
